This document is an electronic record in accordance with the Information Technology Act, 2000, and the applicable rules. It is generated by a computer system and does not require physical or digital signatures.
These Terms of Use constitute a legal agreement between You and RudraBizz Pvt Ltd, a company incorporated under the Companies Act, 1956, with its registered office at Nagpur. This agreement governs your access to and use of the RudraBizz website (“Platform”).
For the purpose of these Terms of Use:
- “You” or “User” refers to any individual or legal entity that accesses the Platform, whether as a registered user or a guest.
- “We,” “Us,” or “Our” refers to RudraBizz Pvt Ltd and the RudraBizz Platform.
By accessing, browsing, or using the Platform, you agree to abide by these Terms of Use in their entirety. Please read them carefully before proceeding. By accepting these Terms of Use, whether implicitly or explicitly, you also agree to comply with RudraBizz Policies, including but not limited to the Privacy Policy, which may be updated from time to time.
Membership Eligibility
Transactions on the RudraBizz Platform are permitted only for individuals who can legally enter into binding contracts under the Indian Contract Act, 1872. Individuals classified as “incompetent to contract” under the Act, including undischarged insolvents, are not eligible to use the Platform.
If you are a minor (under the age of 18 years), you may access the Platform or its content only under the supervision and with the prior consent of a parent or legal guardian.
For any transactions conducted by a minor, the purchase must be made by their parent or legal guardian on their behalf. RudraBizz Pvt Ltd reserves the right to terminate membership or restrict access to the Platform if it is found or brought to our notice that a minor is engaging in transactions without proper authorization.
Your Account and Registration Responsibilities
By using the RudraBizz Platform, you are responsible for maintaining the confidentiality of your Display Name and Password and for all activities carried out under your account.
If you provide any information that is false, inaccurate, outdated, or incomplete, or if we have reasonable grounds to believe so, RudraBizz Pvt Ltd reserves the right to suspend, terminate, or restrict your membership indefinitely and deny access to the Platform.
Your mobile phone number and/or email address serve as your primary identifiers on the RudraBizz Platform. It is your responsibility to ensure that these details remain accurate and up to date at all times. If your mobile number or email address changes, you must promptly update them on the Platform through one-time password verification.
RudraBizz Pvt Ltd is not responsible for any activities or consequences resulting from the use or misuse of your account due to outdated or incorrect contact information.
If you share your account or allow others to access it by creating separate profiles or otherwise, they will be able to view and use your account information. You are solely responsible for all activities conducted under your account and any resulting consequences.
You must keep your account login details (username and password) confidential. Sharing them with others will be considered a breach of these Terms of Use.
You agree to:
(a) Log out from your account at the end of each session.
(b) Notify RudraBizz immediately in case of unauthorized account access.
If we suspect a security breach or misuse, we may require you to change your password or temporarily suspend your account without any liability. RudraBizz will not be responsible for any loss or damage resulting from your failure to follow these security measures.
Commercial Terms and Responsibilities
All commercial and contractual terms are solely between Buyers and Sellers, including but not limited to pricing, shipping costs, payment methods, terms, delivery schedules, warranties, and after-sales services. RudraBizz Pvt Ltd does not influence, determine, or interfere in these agreements. All discounts and offers, including exchange offers, are extended exclusively by the Seller/Brand and not by RudraBizz.
Placing an order on the RudraBizz Platform constitutes a purchase offer from the Buyer to the Seller and should not be interpreted as an automatic acceptance by the Seller. Sellers retain the right to cancel orders at their sole discretion, and Buyers will be notified via email or SMS in such cases. If an order is canceled, any amount paid by the Buyer will be refunded. Additionally, Sellers may cancel orders if the quantity exceeds typical individual consumption levels, either in a single order or across multiple orders. The definition of “typical individual consumption” is determined solely by the Seller and may vary.
RudraBizz Pvt Ltd makes no guarantees regarding product quality, value, or merchantability. It does not endorse, support, or facilitate any sales or purchases and assumes no liability for errors or omissions, whether from itself or third parties.
RudraBizz is not responsible for non-performance, breach of contract, or disputes between Buyers and Sellers. It does not guarantee that either party will fulfill transactions and will not mediate or resolve disputes. Additionally, RudraBizz does not verify the identity, creditworthiness, or legal title of its Users. Buyers are encouraged to conduct independent due diligence before engaging in transactions.
At no point does RudraBizz take possession, ownership, or claim any rights over products or services offered on the platform. It is not liable for delayed deliveries, out-of-stock items, or service disruptions. The Platform serves solely as a communication and transaction medium for Buyers and Sellers.
Business Purchases & GST Compliance
Certain products on the RudraBizz Platform may be eligible for business purchases, allowing Buyers to claim GST input tax credit. Upon purchase, a GST-compliant invoice will be issued, including:
- The GSTIN provided by the Buyer
- The registered business name as specified by the Buyer
Not all products are eligible for business purchases, and eligibility is determined by the Seller. To ensure seamless GST input tax credit claims, Buyers must:
- Provide the correct GSTIN and business details
- Use their registered business address as the delivery location
- Ensure the delivery and billing addresses match (GST input credit may be denied if the addresses belong to different states)
If a Buyer does not provide GSTIN and business details, the purchase will be considered personal, and no tax credit will be available.
RudraBizz is not responsible for verifying the accuracy of GST details provided by the Buyer. Neither RudraBizz nor the Seller will entertain requests for invoice revisions. Buyers are solely responsible for ensuring compliance with applicable laws and regulations.
Liability & Fraud Prevention
RudraBizz and Sellers are not liable if a Buyer fails to claim or is denied GST input tax credit. Buyers agree to indemnify RudraBizz and Sellers against any losses, claims, penalties, or liabilities arising from:
- Incorrect GSTIN, entity details, or tax credit claims
- Non-compliance with applicable laws
- Misuse of GST invoices or third-party details
RudraBizz reserves the right to deny business purchases if fraudulent activity is suspected. Sellers also reserve the right to cancel transactions and issue credit notes in cases of fraud.
Buyers must independently negotiate and agree upon terms related to delivery, payment, insurance, and other conditions directly with the Seller.
Charges
RudraBizz Pvt Ltd may charge a nominal fee for browsing and purchasing on the Platform. RudraBizz reserves the right to modify its Fee Policy at any time. This includes the introduction of new services/fees or modifications to existing charges at its sole discretion.
If any changes are made to the Fee Policy, they will be posted on the Platform and will take effect immediately upon being published. Unless stated otherwise, all fees will be quoted in Indian Rupees (INR).
Users are solely responsible for ensuring compliance with all applicable laws, including those in India, when making payments to RudraBizz Pvt Ltd.
Payment
When using any of the payment methods available on the Platform, RudraBizz Pvt Ltd shall not be responsible for any loss or damage arising directly or indirectly due to:
- Lack of authorization for any transaction(s).
- Exceeding the pre-set limit mutually agreed upon between You and the Bank(s).
- Any payment-related issues arising from the transaction.
- Decline of transaction for any other reason(s).
All payments for purchases or services on the Platform must be made in Indian Rupees (INR), as accepted in the Republic of India. The Platform does not support transactions in any other currency.
Before shipping or delivering your order, the Seller may request supporting documents (such as a government-issued ID and address proof) to verify the ownership of the payment instrument used for the purchase. This is done to ensure a secure online shopping experience for all Users.
Transaction Terms
- The Buyer and Seller engage in transactions as independent contractual parties, and the payment facility is solely a means to facilitate transactions.
- RudraBizz does not assume liability for non-delivery, non-receipt, non-payment, damages, fraud, or breach of warranty related to products or services on the Platform.
- RudraBizz does not guarantee the identity of any User or ensure that Buyers and Sellers complete their transactions.
Payment Facility
- The payment facility provided by RudraBizz is not a banking or financial service but an automated electronic payment system that processes payments via authorized banking networks and payment gateways.
- RudraBizz acts as a facilitator and does not hold funds in a fiduciary capacity.
Payment Facility for Buyers
- When initiating a transaction, you enter into a legally binding contract with the Seller and agree to pay the transaction price via the payment facility.
- The Buyer may extend the delivery or dispatch time in agreement with the Seller through electronic communication, subject to Platform policies.
- Buyers must electronically confirm delivery/non-delivery within the timeframe specified in the policies. If no confirmation is provided, the transaction will be considered completed.
- For Cash on Delivery (COD) transactions, Buyers are not required to confirm receipt of the product.
Refund Policy
- Buyers are entitled to request a refund if delivery is not completed within the agreed timeframe or as specified in the Platform’s policies.
- Refund requests must be initiated within the stipulated period; failure to do so will render the Buyer ineligible for a refund.
- The refund facility may not be available for certain products/services as per Platform policies.
- Refunds will be processed via:
- The original payment method (for electronic transactions).
- Bank transfer (for Cash on Delivery transactions).
- NEFT/RTGS or other RBI-approved electronic fund transfer systems.
- Refunds will be issued only in INR, equivalent to the original transaction amount.
- Some banks may not support electronic refunds; in such cases, alternate bank account details may be required.
- Refunds will be subject to verification and compliance with Platform policies.
Transaction Limits & Security Checks
- RudraBizz reserves the right to impose limits on transaction amounts and frequencies for security reasons.
- Transactions may be declined if:
- The Buyer has a history of questionable transactions or policy violations.
- The transaction appears fraudulent or non-genuine.
- Additional verification checks may be performed before approving payments, and in some cases, the Cash on Delivery option may be disabled.
Suspicious Transactions
- RudraBizz may delay payment confirmation or hold the transaction price if a transaction appears suspicious or involves a high-volume Buyer.
- If a Buyer is suspected of engaging in illegal activity, RudraBizz reserves the right to withhold payments and report the matter to law enforcement authorities.
- Buyers and Sellers acknowledge that RudraBizz is not liable for any damages, claims, or losses arising from transaction delays or cancellations that are beyond its control.
