Intellectual Property Policy

RudrabizZ Pvt. Ltd. (hereinafter referred to as “Company”, as defined in the Terms & Conditions) respects the intellectual property rights of third parties. If you believe that your intellectual property has been used in a manner that constitutes infringement, please follow the procedure outlined below to report such instances.

To assist individuals and organizations in protecting their intellectual property and to build trust between the Company and its users, we have established this Intellectual Property Policy (“IP Policy”). This policy enables us to identify and remove infringing or unlicensed content listed on our website (the “Platform”) when reported by the rightful owner. This IP Policy is in compliance with applicable Indian laws.

1. Intellectual Property

For the purposes of this IP Policy, “Intellectual Property” includes, but is not limited to:

  • Trademarks: Any mark capable of being represented graphically and capable of distinguishing goods or services of one person from another, including logos, designs, trade dress, shapes of goods, packaging, or color combinations, duly registered and/or pending registration under the Trade Marks Act, 1999.
  • Copyrights: Literary, dramatic, musical, or artistic works owned, acquired, or validly licensed under the Copyright Act, 1957.
  • Other Rights: Patents, trade secrets, proprietary know-how, inventions (patentable or non-patentable), discoveries, adaptations, derivatives, or improvements thereof, and other intellectual property rights legally recognized in India.

2. Eligibility to Report

If you are the rightful owner or an authorized licensee of any Intellectual Property (“IP Owner”) and believe that your content has been uploaded or listed on the Platform without your consent, or in a way that infringes your IP rights, you may report the same to the Company.

3. Procedure to Report Intellectual Property Infringement

3.1 The IP Owner must email us at support@rudrabizz.com with a Notice of Infringement in the format provided in Schedule I below.

3.2 Upon receiving a valid Notice Form, the Company will:

  • Verify the completeness and authenticity of the Notice.
  • If satisfied, take the following actions:
    • Immediately delist the infringing product(s) from the Platform.
    • Suspend or block the account of the supplier/vendor responsible for the infringement.
    • Restrict further listings by the infringing party on the Platform.

4. Indemnity

By submitting a Notice Form, the IP Owner grants the Company the right to share the Notice with the concerned parties involved in the alleged infringement. The IP Owner agrees to indemnify RudrabizZ against any claims from third parties arising from or related to the submission of the Notice Form.

5. Consequences of Incomplete or Frivolous Reporting

  • If the Notice is incomplete or deemed frivolous/fake by the Company (at its sole discretion), no action will be taken. The Company may also inform the concerned supplier/vendor.
  • If the supplier/vendor believes the claim is frivolous, they may submit a Counter Claim with supporting documents.
  • The Company may reinstate the account and relist the products if it is satisfied with the genuineness of the Counter Claim.
  • The Company will act based on the documents provided and is not responsible for independently verifying the claims.
  • The Company is not a statutory or judicial authority and will not be held liable for any action or omission taken in good faith.

  2. I/We believe that the listings/material identified in the annexure attached hereto [provide links and details] are unauthorized and infringe upon my/our intellectual property rights.
  3. The basis for this claim is [insert reason, such as test purchase, lab report, or similar documentary evidence].
  4. Accordingly, you are requested to expeditiously remove or disable access to the infringing material/products from rudrabizz.com.
